EastEuro Link hosted its inaugural Conference on Protecting Intellectual Property Rights in China on November 15th 2007 in London. Taking place in the uniquely presented Brewery Conference Centre in London, the sell-out event was attended by a range of leading lawyers and businesses.

Douglas Clark, Partner at Lovells China, introduced the conference and chaired the event excellently throughout the day. He noted that IP registrations will continue to increase and the China is committed to increasing protection, although corruption was highlighted as a potential downside. Dr. Victoria Wang of Rouse & Co. then gave an overview of the status of IP applications in China, before Mr. Asif Ahmad, Asia Pacific Director of UK Trade & Investment detailed the UK and EU initiatives for increasing IP Protection for businesses dealing with China. The audience was then treated to a telephone conference call from the US, from which Susan Hoyler of Qualcomm described the relevance of standard bodies and IPR policies.

After a networking coffee break, Mr. Frank Bernstein, Partner at Kenyon & Kenyon in Silicon Valley USA, began the legal methods section by focusing on patent protection and litigation in China. His speech included remedies for affected businesses and a series of recent case studies. Ms. Morag MacDonald, Partner at Bird & Bird, then explained the difficulties in registering trademarks in the Chinese language and the appeal process against trademark and design infringements. Mr. Alastair McCulloch, Partner at Jones Day, turned the focus towards Copyrights, highlighting copyright law in China, the administrative process and penalties, before Mr. Philip Nolan, Partner at Mason Hayes+Curran addressed the issue of online protection and concluded that Chinese law is sufficient to cover IP protection. Finally, Mr. James Cleeve, Partner at Merks & Clerk China, examined prosecution procedures in China, giving useful suggestions for both patent and trademark filing.

Following a lively lunch break where delegates had the opportunity to network and look at the various exhibition stands on display, Mr. John Smith of the Textile Institute presented a case study of IPR policy in China from the Textile industry perspective. Then, Mr. Steve Mohun, Partner at Hasletine Lake, summarised the situation and claimed that businesses should not be sceptical of successfully protecting their IPR in China. After some questions and concluding remarks from the chairman, the conference was drawn to a close.

The event brought together a number of influential players in Chinese IP law to engage in numerous discussions and listen to some excellent insights into the field.
